Someone that defends: a<span style="font-style: italic;"> non-interventionist State</span> on the economy; a pervasive but realistic <span style="font-style: italic;">Welfare State</span>; the deepening of recent <span style="font-style: italic;">societal and legal progressive changes</span>, such as abortion (2006) and same-sex marriage (2010).<br /><br />The road is beyond rocky.<br /><br />Every political force will tell you, for example, that the State should support small and medium companies. They probably have in mind lots of subsidies and State-funded internships that will only serve to fund unscrupulous businessmen at the expenses of tax-payers and the interns themselves. They can hardly think that all the licenses, declarations, forms, tax-returns, etc., all those annoying and often imbecile procedures hurt a lot more the small companies than the big ones. And they can hardly think, or if they do think, they do not act on it, that complex fiscal systems only defend the richer, the best informed, those who can pay for someone to play with the law or win the subsidies. No political force realizes that the more power the State (and the local authorities) has on the economy, the bigger problems such as corruption will be. <span style="font-weight: bold;">Centralization is not only economically hurtful. It is morally wrong and ethically deviant.</span><br /></div><br /><div style="text-align: justify;"><span style="font-weight: bold;">All political forces will also tell you how much they love Welfare State. </span>But the Left is unable to accept the reforms in Social Security that will guarantee its sustainability; in Education, pedagogic theories of dubious origins have resulted in undoubtedly disastrous results. The Right knows its electorate, and does not seem all too keen on rising retirement ages, but they accept that the rich - and only the rich - get off of the system and have their pensions at least partially in private schemes. And, of course, the Right wants dearly education vouchers that will be used to finance religious schools (even more than they already are) and to allow, via this State subsidy, the upper sections of society to keep their children in private schools, away from the general scoundrel and the calamitous public education system governed by the Left.<br /><br /><div style="text-align: justify;">Like we have recently seen with the judges and with the teachers, <span style="font-weight: bold;">all political forces, once in opposition, will block any kind of reform affecting powerful professional groups</span>. It is easy to cut any normal civil servant wage. Try doing that to a judge: from the far-ends of Communism to the far-ends of Conservatism, all voices will rise against you. And that explains why, much more than labour laws (something that all Liberals tend to emphasize) one of Portugal's biggest problems is actually the (at best) inoperative judicial system.<br /><br />In our near future, we may get to a situation in which the Welfare State starts being dismantled because we need to cut costs. But the problem in Portugal is certainly not a big Welfare State. Checking OECD data, you may easily find out that Portuguese Welfare State is as big as any other European Welfare State, certainly smaller than not few of them. And that <span style="font-weight: bold;">non-biased analysis of the Welfare State is what distinguishes a Left Liberal from many other Liberals</span>.<br />What we must question is where all the rest of the money goes in Portugal. Why do we have so many doctors (and we do)? Why do we have so many judges (and we do, despite our calamitous judicial system)? Why do we have so many unproductive public investments? Why so many subsidies? Why so many taxes imposed for "social justice", with no positive effects whatsoever after all the tax benefits that only benefit the rich? And<span style="font-weight: bold;"> it is this critical view of the State's power of intervention in the economy that distinguishes a Left Liberal from the Socialist Left</span>.<br /><br /><br />The road is rocky - but I still believe that <span style="font-style: italic;">a Liberal Left, a Liberalism that knows that (sane) social policies are crucial for people to be free, a Leftism that understands that economic growth is crucial for social justice, is the only key for our future</span>. <span>We need to continue of road from religious serfdom to rational freedom. We need a State that keeps its hands off the economy. So, for example, you have Zapatero, a decent politician that changed the face of Spain and affronted PP, a party depending from Opus Dei and still holding on in some way (or at least in some factions) to Franquism. What did he do to PP's good heritage from PP? Well, the recent defeat in the local elections is a proof that Spanish <span style="font-weight: bold;">people do prefer, when the going gets rough, competent bastards to incompetent good guys</span>.<br /><br />So that is the <span style="font-weight: bold;">challenge. Do the right things for the right reasons</span>. It cannot be impossible to have a progressive society, opportunities for all and economic growth. In fact, it makes sense that all those factors go hand in hand. Growth creates opportunities that can be effectively used by people if social prejudices do not create artificial barriers to social mobility and individual freedom.<br /><br />So Portugal needs a political force that is clear on a number of subjects:<br /><ol><li><span style="font-weight: bold;">We need a change in mentalities regarding finances</span>: we have to save part of what we earn, we cannot spend more than what we earn; we cannot see as normal having deficits of more than 3%, and certainly not on consecutive years (or, as is the case, decades!).<br /></li><li><span style="font-weight: bold;">We need a change in mentalities regarding the economy</span>: we have to allow entrepreneurs to appear, we have to avoid defining what the economy should look like and let society decide it on its own; we have to ask ourselves why countries having simpler fiscal laws or having more agile judicial systems keep better growth rates than us.<br /></li></ol><span style="font-weight: bold;">That is what I call the "Liberal" side of the answer. The other what I call the "Left" side:</span><br /><ol><li><span style="font-weight: bold;">We need to have a more intelligent view of society</span>: we have to put aside our pre-conceived ideas about social rights, we have to protect less those who are already powerful, we have to have the same laws for everybody. </li><li><span style="font-weight: bold;">We need to defend a good public Education system</span>: public schools are the only way of creating a "republican" society, a society based on equal opportunities; public schools must be ideologically neutral (no financing of religious institutions) and equally accessible for all (the education voucher is actually just a way of financing private schools and rich families that would in any case put their children in such schools because they know that exclusive environments are a way of maintaining the ancestral dynasties that rule the country); but public schools also have to be demanding, hard, and discipline must prevail - otherwise the middle class will no longer believe in it.<br /></li><li><span style="font-weight: bold;">We need to defend a good public Health system</span>: WHO data proves that the Portuguese health care system is, counter-intuitively, one of the few things the country can be proud of; it also shows that public systems are cheaper and more cost-effective than private ones; but it needs to face the ageing problem and be sustainable.</li><li><span style="font-weight: bold;">We need to defend Social Security</span>: and this can only be done with radical reforms, including eventual limits on accumulation of pensions and fixing ceilings, while the retirement age has to go as up as 68, eventually more if needed - we have to be prepared for it, if we do want to keep a <span style="font-style: italic;">public </span>pension system, having at the same time a good notion of intergenerational justice in which young people are not transformed into fiscal slaves of richer, more numerous (thus more powerful in a democratic society) and older generations.<br /></li></ol><br />___________________________________<br />(1) <span style="font-size:85%;">Do not mix up Europe and the United States. The American Right is only right when it shuts up, and since Republicans are very verbal, they are never right. The years in which the IMF was here seem to be the last years in which some reasonable budgetary policy was followed in the country, with a large coalition of the two main parties, PS (Social Democrats) and PSD (at the time, Liberals by international affiliation, though Conservative at heart).<br /><br />After that, we had <span style="font-weight: bold;">ten years of PSD governments</span>, the ones in which the weight of the State grew the most.<br />We had <span style="font-weight: bold;">six years of PS governments</span>, in which the deficit was reduced, but no reforms were introduced, in some cases pursuing the PSD reality-detached policies, such as regarding pensions. We got to 2001/2002 amid a political, social, budgetary and economic crisis that allowed a victory for a coalition between the <span style="font-weight: bold;">two Conservative parties, PSD and CDS</span>.<br />After <span style="font-weight: bold;">less than three years</span>, the country was angry. The Right had promised a "Liberal Revolution" and instead no real changes came, those which came were less than understandable and the government supported an unfair war that had the opposition of over 75% of the population. The Prime Minister, Barroso, fled the country and left it with all its budgetary and economic crisis to be solved, and got the dream job at Berlaymont, and left at his place a man that became a practical joke (and a very sad one) and that had the honour of being the first Portuguese Prime Minister to be fired by the President for outright incompetence.<br /><span style="font-weight: bold;">At the 2005 elections</span> the two Conservative parties had the worst result for the Right in the democratic period of Portugal. Not even in 1974/75, when the country was on the verge of Socialism, did the two Right-wing parties got such a bad result; on the contrary, <span style="font-weight: bold;">PS had its best result ever</span>.<br />And so, we could think (I certainly did) that with an absolute majority and five years of economic crisis the situation would change. Until 2008 it seemed so. It was not perfect, but the Socialists did more and did better than the Right. Right - but wrong. <span style="font-style: italic;">As soon as the financial crisis broke down the old Keynesian monsters were unleashed and PS, that had managed to drop the 6% budget deficit inherited from the Right to a 2,8%, soon brought us to unimaginable deficits of over 9%, while persisting with megalomaniac plans for a new airport and a high speed train</span>.<br /><br /><span style="font-weight: bold;">The rest of the story is more or less known</span>: the deficit is still not under control, the markets and rating agencies dragged the country to its knees, the government tried to resist receiving the international aid, but finally had to accept it, while the now (after the 2009 elections) minority Socialist government and the opposition were unable or unwilling to find a compromise, leading to the upcoming elections in the beginning of June.<br /><br /><span style="font-weight: bold;">How could we summarize Portugal's last years?</span><br />- Persistent economic <span style="font-weight: bold;">crisis</span>;<br />- Persistent <span style="font-weight: bold;">unbalanced budgets</span>;<br />- <span style="font-weight: bold;">No real differences</span>, in economic and financial policies, <span style="font-weight: bold;">between Centre-Left and the Right</span>;<br />- <span style="font-weight: bold;">An irrelevant Left</span>, barricaded in an unwillingness to compromise, though they represent about 20% of the electorate;<br />- <span style="font-weight: bold;">Persistent marks of unequal development</span>, with education results and the most unequal society in Europe and with one of the lowest levels of social mobility, only to be equalled by the United States;<br />- Crisis is not used as a moment of reflection and reform, but ends up in <span style="font-weight: bold;">another wave of migration</span> towards Europe or Africa, such as now is happening with many skilled young Portuguese;<br />- While changes, cuts and reforms that affect poorer citizens may be done, it is <span style="font-weight: bold;">impossible to introduce changes affecting professional corporations</span>, such as judges, doctors or teachers.<br /><br /><span style="font-weight: bold;">How can we move from this? Não considero que o feminismo seja necessariamente uma colecção de disparates pós-modernos de linguagem PC. O feminismo pertence a uma tradição radical, de Esquerda, de libertação do indivíduo. O feminismo pertence a uma tradição anti-clerical, de crítica às sociedades patriarcais que dominam os países de religião abraâmica (e não só, mas fiquemo-nos por aqui).<br /><br /><a href="http://5dias.net/2010/07/14/a-roupa-e-a-vida-das-mulheres/#more-42979">Não posso por isso senão ficar boquiaberto quando vejo que, nesta Europa que conhece hoje o seu mais feliz período de liberdade (e por isso, talvez o seu último antes de regressar às trevas religiosas) a Esquerda, ao mesmo tempo que critica a desigualdade salarial entre homens e mulheres (17,6%, um crime; questiono-me se é nas mesmas profissões), acha aceitável a assunção pública da inferioridade moral das mulheres. </a><br /><br />Pergunto-me: se fosse a Igreja Católica a decidir que todas as mulheres deviam cobrir-se da cabeça aos pés, será que a Esquerda reagiria da mesma forma?<br />Pois, a resposta é simples, não é?<br />No entanto, criticar uma "tradição" muçulmana (que, na verdade, nem é assim tão tradicional quanto isso) é sinal de intolerância.<br /><br />A questão impõe-se: mas a enxurrada de proibições é solução ou agrava o problema (isolando, por motivos vários que não vou aqui desenvolver, as mulheres afectadas)? Desconfiemos das respostas simples. O mero véu é para mim nojento. Sim, dá-me nojo ver uma mulher com um véu religioso. Mas não apresenta, normalmente, perigo. Já os véus que cobrem toda a face, e pior ainda, a burqa, colocam reais problemas de segurança.<br /><br />Há outras questões paralelas que poderíamos colocar. Ao fim e ao cabo, o Ocidente, essa organização de malfeitores, não vai à Arábia Saudita dizer como eles se devem comportar. Os ocidentais sabem que quando vão a esses países têm de tomar especiais cuidados - e de respeitar minimamente a cultura local.<br />Curiosamente, pedir aos imigrantes muçulmanos que respeitem a nossa cultura, isso, é inaceitável.<br /><br />Parece que a Esquerda parece defender o denominador mínimo comum, não apenas na economia, mas também na cultura: quanto mais rasteiro, melhor. Respeitem-se os intolerantes, ataquem-se os progressistas.<br /><br /><span style="font-weight: bold;">Como liberal social, considerando-me uma pessoa de centro (eventualmente centro-esquerda?) não posso deixar de lamentar a degenerescência do espaço socialista. Já há muito que perdeu o internacionalismo. De há uns anos para cá, está a perder o feminismo. Os liberais escandinavos são tão relativistas e tão multiculturalistas quantos os socialistas e os conservadores escandinavos. O seu passado pacífico fá-los pensar que a religião não é uma coisa assim tão nociva. Pelo contrário, os liberais do Benelux, países que conhecem o catolicismo de perto, bem como as lutas religiosas entre várias seitas, são bastante mais universalistas, condição que partilham com os socialistas (não tanto os conservadores, pelo menos nos Países Baixos; na Bélgica já não há conservadores, por isso é difícil dizer).<br />Não é por acaso, Mariana, que em França ou em Espanha as pessoas querem impedir o véu; não é por acaso que no Reino Unido ou na Noruega haja raparigas de ascendência muçulmana que são mortas em crimes de honra e toda a gente ache normal. É que nós, aqui nos países de tradição católica, passámos séculos a </span>morrer na cruz</span><span style="font-style: italic;"><span style="font-size:85%;">. Passámos séculos a lutar contra a opressão religiosa. O segundo Governo Sócrates vai cair - e, posso acrescentar, vai cair quase tão mal quanto caiu o segundo Governo Guterres.<br /><br />O final do primeiro Governo Sócrates já nos fazia adivinhar o descontrolo que se seguiria. Muitos disseram que a crise foi uma bênção para os socialistas. A um ano das eleições poderiam, a coberto de estímulos à economia, começar a esbanjar dinheiro em eleitoralismos.<br />Honestamente nunca percebi como poderia isso ser benéfico para os socialistas. O que levou Sócrates à ribalta não foi o populismo. Foi uma capa de seriedade. Depois do circo em que se tinha tornado a coligação conservadora, o país queria (ou pelo menos aparentava querer) consistência, estabilidade, reformas. E o défice tinha de baixar. Poucas pessoas se opuseram seriamente, nos primeiros dois anos, às medidas de contenção orçamental.<br /><br />Claro que o país aparentava querer seriedade, porque as corporações (médicos, advogados, juízes, professores) sabem que é com meias tintas que os privilégios se mantêm incólumes. Mas alguma coisa estava a ser feita e os índices de popularidade do primeiro ministro, do governo, do PS, eram altos.<br />A segunda metade do governo (2007-2009) foi um desastre. O défice disparou para níveis inauditos. E Sócrates continuava crente que era com investimento público que o país entrava nos eixos. Mas não entrou, e continua a não entrar.<br /><br />Não fosse o Euro e a UE, o país já teria entrado em bancarrota. Felizmente, o chicote alemão está a obrigar o governo a fazer marcha atrás. A tentação de governos irresponsáveis é somar, a um erro inicial, um erro mais para corrigir esse erro e assim sucessivamente.<br />Não quero dizer que, conscientemente, os portugueses puniram o PS em 2009 e punirão ainda mais em 2011 pela sua irresponsabilidade orçamental e pela sua má política económica. Mas há uma conjunção de factores arrasadores para o governo:<br />- O investimento público não cria riqueza mas aumenta a despesa;<br />- Mais impostos e menos riqueza é uma dupla carga que ninguém pode apreciar;<br />- E os europeus não estão dispostos a suportar todas as imbecilidades da Europa do Sul - pelo que exigiram medidas drásticas para solucionar o problema do desequilíbrio orçamental.<br /><br />Em vez do caminho alternativo de contenção orçamental e corte de impostos (sobretudo IRC) no início da crise, o governo preferiu gastar todo o dinheiro num espaço de um a dois anos.<br />Deviam saber que o mal se faz de uma só vez e o bem pouco a pouco. Com as opções tomadas, Sócrates dedica-se agora a contas de merceeiro, vendo onde pode cortar. If the result of individual choices (of individual free choices, so, free from <i>fraud and violence</i></span><span style="" lang="EN-GB">) is a radical free market system (or “pre-welfare-state capitalism” as Jonathan Wolff puts it) then a justification must be provided to limit individual choices. Saying that the victory of a given social system is the proof of its wrongness can hardly be a valid argument <i>against</i></span><span style="" lang="EN-GB"> it. This is the bottom line of any critique of capitalism in a broad sense (independently of the specific kind of state – minimal state, welfare capitalism, etc. – is actually defended to keep such economical system). Nevertheless, it is a challenge to find any contemporary political philosopher who would, even if believing in it, be so honest to make such a statement. João Almeida afirma que se trata de uma <a href="http://daultimafila.blogs.sapo.pt/2271.html">questão jurídica</a> (portanto, <span style="font-weight: bold;">alguém que diz que ao Estado nada confia, confia afinal na definição pelo Estado de uma realidade social fundamental</span> - os meus parabéns pela cambalhota argumentativa) e Michael Seufert, pelo contrário, afirma que se trata de uma <a href="http://daultimafila.blogs.sapo.pt/3077.html">questão pré-estatal e até (sacrilégio!) pré-religiosa</a>.<br /><br />Não posso deixar de <span style="font-weight: bold;">notar que se trata de duas argumentações completamente díspares.</span> Entre si e, também, daquilo que se tem lido da maior parte dos opositores ao casamento entre pessoas do mesmo sexo. A única coisa que as une é mesmo, sejamos honestos (e já sei que vou ser acusado de ser intolerante e politicamente correcto, ou politicamente incorrecto, ou seja lá qual for o chavão que está na moda por certas e determinadas bandas), o preconceito.<br /><br />E voltamos à polissemia (e com isto vão dizer outra vez que se trata de "filosofia complexa"):<br /><ol><li>preconceito porque se trata de argumentos que não são justificados nem explorados até às suas consequências últimas. Já expliquei o problema do argumento de João Almeida, que não se coaduna com a sua alegada (e suspeito, é mesmo só alegada) desconfiança visceral face ao Estado. Já Michael Seufert não explica <span style="font-weight: bold;">por que motivo se dá legitimidade ao Estado ou às religiões para emitirem regras relativamente a uma realidade que as precede.</span> Acaso o Estado legisla sobre se o a Terra gira à volta do Sol ou o contrário (bom a Igreja já o fez, mas adiante)?</li><li>preconceito, enfim, por aquilo mesmo que estão a pensar, por pura discriminação em relação às minorias sexuais. Eu normalmente tento evitar este tipo de abordagens; para mim, nós somos livres de nos darmos com quem quisermos. Ninguém é obrigado a gostar nem a dar-se com gays ou lésbicas. Mas ninguém tem o direito de lhes retirar um centímetro dos seus direitos, <span style="font-style: italic;">ou seja</span>, das suas liberdades que não limitam a liberdade de ninguém mais. João Almeida tem razão. Ele leu alguns autores liberais e decorou bem a frase. No entanto, não percebeu nada do significado e não sabe aplicar esta ideia ao concreto.</span><br /></span><span style="font-size:100%;">Para demonstrá-lo vou analisar <span style="font-weight: bold;">o conceito de felicidade</span> nas suas <span style="font-weight: bold;">duas possíveis acepções: a puramente individual (ou ética) e a social (ou moral).</span></span></div> <p style="margin-bottom: 0cm;" align="justify"><span style="font-size:100%;"><br /></span></p> <p style="margin-bottom: 0cm;" align="justify"> <span style="font-size:100%;"><span style="font-weight: bold;">De um ponto de vista ético</span>, das escolhas que compõem o <span style="font-style: italic;">ethos </span>ou carácter de um indivíduo, qualquer intromissão do Estado é nociva na medida em que é impossível um poder centralizado abarcar todos os conceitos de felicidade existentes, cujo número é, no limite, igual ao número de indivíduos que compõem uma dada sociedade. De facto, aqui <span style="font-weight: bold;">a felicidade assume o sentido mais prosaico, ou seja, a felicidade aqui diz respeito ao gozo, ao prazer e à ausência de dor </span>e isto de uma forma continuada. Sucede que <span style="font-weight: bold;">nenhum Estado pode proporcionar aos seus cidadãos uma tal condição</span> sem causar ainda mais infelicidade e sem impôr uma visão unitária de felicidade (aquilo que, como veremos, corresponde à felicidade em sentido moral). As variedade de conceitos de felicidade e de fontes de infelicidade são tão vastas que nenhuma soma de recursos poderia jamais cobrir os primeiros nem exaurir as segundas.<br /><span style="font-weight: bold;">A única coisa que o Estado pode pois fazer em relação à felicidade individual é remover as barreiras impedem cada indivíduo de ser feliz, desde que a sua felicidade não colida com a de outrem. </span>É justamente por isso que o liberalismo sempre pugnou por leis mais abstractas. Excesso de leis implica uma tentação de controlo da realidade que não é nunca possível: ela é dinâmica e caótica, tem uma ordem descentralizada que não se compadece das tentativas de controlo por parte de centros de poder.<br />Aplicando esta ideia ao caso dos casamentos entre pessoas do mesmo sexo, o que foi feito foi aumentar o nível de abstracção da lei, removendo uma limitação que impedia alguns de seguirem o seu próprio conceito de felicidade individual; a remoção dessa limitação, por outro lado, não implica um ataque à liberdade de outros indivíduos (se no seu conceito de felicidade não couber casarem-se com pessoas do mesmo sexo, apenas têm de não se casar com pessoas do mesmo sexo).</span></p> <p style="margin-bottom: 0cm;" align="justify"><span style="font-size:100%;"><br /></span></p> <p style="margin-bottom: 0cm;" align="justify"> <span style="font-size:100%;">É o segundo conceito que realmente é problemático; <span style="font-weight: bold;">a felicidade moral </span></span><span style="font-size:100%;"><span style="font-weight: bold;">não é já a felicidade como gozo de prazeres físicos ou materiais, mas a felicidade como bom ordenamento de uma sociedade</span>. </span><span style="font-size:100%;">O que João Almeida defende, ao contrário do que as suas palavras poderiam fazer crer, é um conceito de felicidade moral, ou seja, uma moral substantiva; e pretende defendê-lo impondo-a a todos os demais indivíduos. Vou pôr de parte a constatação de que o Estado português é laico e que portanto as suas leis não dependem de qualquer religião. A argumentação absoluta e profundamente conservadora de que o casamento nasce da tradição cristã e católica (o que, ademais, é um perfeito disparate a todos os níveis, começando pelo histórico e antropológico) denuncia que o<span style="font-weight: bold;"> que João Almeida pretende é subjugar toda a sociedade portuguesa à felicidade moral católica</span>.<br /></span></p> <p style="margin-bottom: 0cm;" align="justify"> <span style="font-size:100%;">Qualquer liberal deve saber que jamais a “tradição” é um bom argumento. O liberal não labora mentalmente nas ficções culturalistas e historicistas. O liberal, falando de política, olha sempre a “tradição” com desconfiança porque conhece-lhe as tonalidades totalitaristas. (e mesmo quando a refere de forma positiva, como Hayek faz, é para sublinhar a dinâmica humana, a nossa capacidade de adaptação e aprendizagem de melhores e mais justas regras). O liberal argumenta sempre na base do universal como composto de particulares, em que cada particular é tão digno quanto qualquer outro (e por isso mesmo as regras devem ser universais, abstractas e imparciais). <span style="font-weight: bold;">O liberal jamais pega num particular (numa “tradição”, numa moral, numa ideia totalizante de sociedade) e o transforma num universal. </span></span> </p><span style="font-size:100%;"><br /></span><p style="margin-bottom: 0cm;" align="justify"> <span style="font-size:100%;"><span style="font-weight: bold;">Contrariamente ao que João Almeida possa pensar é ele quem entende que o Estado deve zelar por um conceito de felicidade. </span>Para terminar e ser absolutamente claro, se o Estado não pode tentar fazer-nos felizes, também não tem o direito de nos fazer infelizes. É mentira. A percentagem é muito superior. Se pegarmos na CGD (detida pelo Estado) no BES, no BCP, na Somague, na Mota-Engil e em todas as outras empresas (pequenas, médias e grandes) que orbitam em torno do Estado, sendo por ele influenciado e normalmente determinando as suas decisões (não é por acaso que financiam determinados partidos), veremos que o peso do Estado é muitíssimo superior à percentagem vulgarmente e de forma simplista apresentada. </p><p align="justify"></p><p align="justify">Uma boa prova disso mesmo é o facto de, por causa das suas posições a respeito do Banco de Portugal, do BPN e do BPP, o CDS estar agora a atravessar uma crise de financiamento. É que os empresários portugueses, que com tanta frequência cospem no prato do Estado, estão mais do que habituados a comer o que nele está. On the other hand, this may allow extremists to be sanctified as freedom-fighters. They will always find some fringe of public opinion that will support them for being against the evil western capitalist powers, accusing this countries of either not being enough tolerant towards misogynous totalitarian religious beliefs or of being too tolerant in face of racial or sexual minorities.<br />To break these mistaken views and to clear all foggy discussions, I think that we must adopt a more coherent but also dynamic starting point: the concept of freedom in its multiplicity. Statal violence isn’t any better than other forms of violence if not to protect individual freedom. That is a key point that must be stressed.<br />Publishing the PATRIOT Act doesn’t make political repression, private communications’ violation or torture any more valid on a moral basis. The defeat of “pro-security” arguments starts at its very beginning: giving huge powers to obscure and self-illuminated bureaucrats or politicians does not create security. It only transfers (or, more probably, sums) the sources of insecurity. For example, can French citizens feel safe if secret services – under the noble mask of the fight against terrorism – start gathering information about their political activities, sexual orientation or health status (let’s see what will happen with Edvige and Cristina)?<br />On the other side, we have “pro-freedom” arguments. This is a much more difficult ground. Freedom is the core issue, and the proof of that is that even when we put it against the concept of security, we do so in order to know which is the most balanced position: we don’t want that freedom may be used against freedom, and so we must put some kind of restraints. Defending the rule of law is a political, ideological, moral conviction; it is also, pragmatically speaking and in accordance with the previously written, the best way to defend security.<br />Nevertheless, we must also keep in mind that a law that is not able to protect individuals from harms (whatever the source of such harms and whatever the origin of this law’s inefficiencies may be), that law, rules nothing. </p><br /><p align="justify"><br />I do not believe that straight answers can honestly be given when we presently face a deadly combat with terrorists that fear nothing (not even death) except the possibility of not entering an imaginary place. It is quite different from other clashes of European recent History, such as extremist left or right terrorist movements, or even the secessionist movements like IRA or ETA. Europe was never more Europe than it is today. What suffered a severe setback in Nice was europeism, the passion, the utopia, the want of a Europe that is not just a well succeeded collection of national egoisms […].<br /></em><strong>Eduardo Lourenço</strong>, <em>in <strong>Europe Disenchanted – For a European Mythology</strong> </em></span></p><p align="justify"><br />Dutch, French, Irish. Are all these three people eurosceptics? Does No mean No Europe, No to Europe, or does that mean No to this Europe? But what other Europe could there be? Isn’t there just one reality – geographical, political, historical, cultural?<br />Well, the question already gives an answer. Europe may mean several things. The question is if Europeans are against Europe, against European Union, against what exists or instead if they are more radical and they don’t really want what Europe intends to be. That would lie on a conviction that everybody knows what Europe in general, and EU in particular, will be, or at least wants to be. Is the No caused by EU’s goal or is it because, bluntly saying it, nobody knows what is its goal?</p><p align="justify"><br />The European communities started with quite a parsimonious (at least by our present standards – not so by those of the 1950’s) set of policies (controlling coal and steel, for example) but with the strongest moral convictions and a sophisticated theoretical pillar. Neofunctionalism – both influencing and being influenced by European integration process – proved to have a point: economical integration furthered political and (more) economical integration.<br />It is disturbing that, while having simple targets, European communities had such idealistic and – let’s put it that way – utopian elites. On the other hand, and since the 90’s and in the beginning of this new century, when the integration process came to real political union, we see a spillback; not a practical spillback, but a moral and a political one.</p><p align="justify"><br />The main problem seems to be not a lack of existence of Europe (we so often forget the number of things we couldn’t do with no integration process) but the lack of direction. Let us see the Irish example: 80 to 90% of the electorate votes for europeist parties. In general, they vote for democratic, pluralist parties that defend civic, individual and social rights, tolerance, free market, environmental protection.<br />Ideological differences aside, this common set of values, shared by an overwhelming majority of Europeans, may perfectly be seen at the heart of Europe as a project. As Kant observed, we need regulative ideas of reason: we know that we cannot attain an ideal situation, but we can (we must) try to reach situations that are closer to this ideal. It is a utopian departure point (we set our eyes on something that doesn’t exist) to reach a very pragmatic approach on reality (how must we act in order to reach a better situation?). </p><p align="justify"><br />Given this, given that Europeans do have a common set of ideals, what is the problem? Does EU lack utopia? Well, it seems so. The realpolitik arrangements, intergovernamentalism (with governments criticizing back home and blaming “Brussels”… for what they negotiated in Brussels), negotiations around CAP (swallowing over 40% of EU’s budget for political reasons and with – at least – doubtful economical results, both in Europe and abroad), the opt-outs of the United Kingdom and Poland on such basic things as labour laws or sexual and religious tolerance are not exactly a very good way of handling the idealistic and humanist inheritance of Robert Schuman or Jean Monnet.<br />So if core values do exist, but the practice has been at least not very good, probably a bit of utopic pragmatism (we know what we want, we haven’t yet found the best way to get it) may be a solution. Europe already has a kratos – an institutional building. What it doesn’t have is a demos, a European people, that is: people that think as Europeans (and not just as part of their national communities). </p><p align="justify"><br />CaféBabel is surely a way – through media and public opinion – of making that European people. But in the last years (and sometimes precisely in consequence of some No in a referendum) political campaigns have been arising. Probably, and over the time, they will multiply. There are very good examples of what is coming in the next years, may that be one single and simultaneous referendum at an European level (EuropeanReferendum.eu), the pre-electoral presentation by each European party of their candidate for the Comission (Who-is-your-candidate.eu) or transforming what has been until this moment loose parliamentary groups at the European parliament in true, effective parties running for the EP (FiveDemands.eu).<br />So many utopic demands can only have good results. Over a century after Victor Hugo’s speech at the Congrès de la paix, the European communities were born. That was an astonishing leap. We don’t need that much time to take so little steps.<br /></p>Igor Caldeirahttp://www.blogger.com/profile/01059359916396807075noreply@blogger.com1tag:blogger.com,1999:blog-346053445710438531.post-33260372234397962462008-09-14T09:50:00.004+01:002008-09-14T10:19:15.226+01:00Sim, sim e sim: bigamia, poligamia e incesto<p align="justify">A Nova Democracia não faz a coisa por menos quando quer combater os defensores dos casamentos entre pessoas do mesmo sexo: o coordenador da ND de Braga, Carlos Borges, perguntou ao PS e ao BE do seu distrito o que pensam a respeito da poligamia, da bigamia e do casamento entre irmãos. </p><p align="justify">Deplorando a provocação no que à dimensão prática concerne - não conheço ninguém que pretenda casar-se com duas ou mais pessoas, ou com o irmão ou irmã - louvo-lhe no entanto o desafio intelectual que a questão representa. A nossa instintiva resposta será dizer que são situações diferentes; mas não são. O problema para quem defenda o casamento homossexual mas se oponha a estas três hipóteses é o mesmo que se coloca a quem se opõe ao casamento homossexual. </p><p align="justify">O nome desse problema é <strong>cultura</strong>; perdoem-me os antropólogos pela leviandade, mas a cultura é essencialmente (não sempre, mas habitualmente) um aglomerado de preconceitos não submetidos a um exame crítico. São hábitos de pensamento e de acção e não têm a dimensão radical que só a Razão pode dar a qualquer posição. </p><p align="justify">A resposta às perguntas colocadas pela Nova Democracias faz-se por quatro ou cinco perguntas:</p><ol><li><div align="justify">É de adultos que estamos a falar?</div></li><li><div align="justify">Estão conscientes do que estão a fazer?</div></li><li><div align="justify">Fazem-no sem qualquer tipo de coerção?</div></li><li><div align="justify">Afectam a liberdade de outrem?</div></li><li><div align="justify">A decisão é reversível?</div></li></ol><p align="justify"><strong>Maioridade</strong>, <strong>Consciência</strong>, <strong>Ausência de Coerção</strong>, <strong>Soberania Individual</strong> e <strong>Reversibilidade </strong>são as pedras de toque de qualquer questão comportamental. Por muito que os nossos preconceitos nos digam que não, não há nenhum argumento extraível do conceito de Liberdade que nos impeça de aceitar qualquer uma das três situações referidas, cumpridos os pressupostos acima indicados. </p><p align="justify">Pela minha parte, o desafio maior (aquele que me repele) é o do casamento incestuoso. Há um argumento bastante interessante aqui, que é o da "saúde pública" (ou seja, a consanguinidade). But in old times this contest was between subjects, or some classes of subjects, and the government. E que, se não há um povo europeu, que sentido faz haver instrumentos próprios dos de um corpo cívico, como eleições comuns e referendos comuns aos vários países da União Europeia?</p><p align="justify">Sem discutirmos para já se de facto somos ou não cidadãos europeus (o meu passaporte diz-me que sim, a escassez dos meus direitos políticos diz-me que sou um súbdito) o mais importante é discutir qual o conceito de "cidadão" que queremos adoptar. É<strong>-se cidadão em função de uma comunidade política</strong> juridicamente constituída, uma unidade política - um Estado, <em>normalmente</em> - que existe em função de algo, que é criado por algo. A criação do Estado, a sua fundação, remete-nos para o <strong>conceito de nação</strong>. É no questionamento da noção de <em>nação</em> que encontraremos respostas válidas (e que denunciam opções políticas e morais) à questão. </p><p align="justify">Há fundamentalmente <strong>duas perspectivas sobre a nação</strong> como elemento significante do Estado. A <strong>perspectiva conservadora e romântica</strong> é a de que a nação é o produto da História. Como Burke escreveu, não há Direitos do Homem: há direitos dos ingleses, dos franceses, etc.. A nação não tem um acto fundador, é um processo evolutivo no seio do qual pessoas surgem e ao qual as pessoas devem respeito e obediência. Por oposição, existe a <strong>nação contratualista, liberal e revolucionária</strong>, produto já não da História, mas da Vontade. A pessoa cede lugar ao indivíduo isolado que, dotado de direitos inalienáveis (comuns a todos os indivíduos) realiza um contrato para melhor os defender. </p><p align="justify">Sustentar a ideia de que o homem não tem direitos universais mas apenas aqueles que a sua comunidade lhe dá previamente implica uma subordinação de cada um a um todo que o supera. Pelo contrário, os direitos universais fundam o indivíduo moderno, dotado de um núcleo mínimo de autonomia que a cultura, as instituições, o Estado, os partidos, as religiões ou qualquer outra construção humana não tem o direito de vergar.<br />Não é pois já o Estado que brota da vida colectiva, não são as nações que o fundamentam, mas a protecção do indivíduo e da sua liberdade. A tese do tiranicídio vem nesta linha - os indivíduos não são constrangidos a manter uma situação apenas pela sua factualidade jurídica. O indivíduo livre é um criador, um transformador da da comunidade política no sentido de melhor servir o seu fim (repetimos, a defesa da liberdade individual).<br />O conceito-chave aqui é o <strong>poder criador: não é o Estado que permite a vida dos homens, são os homens que estabelecem o Estado</strong> (assim se antecipa, politicamente, o salto filosófico de Feuerbach: não foi o homem que foi criado por um deus, é deus que é uma criação humana). </p><p align="justify">E, aqui chegados, a questão da existência ou não do "povo" europeu adquire contornos novos. Pode bem ser verdade que não haja um <em>demos</em> europeu. Mas há um <em>kratos</em>. Um núcleo de poder sustentado, sem dúvida, juridicamente mas em choque directo com os direitos naturais dos europeus. A<strong> inexistência hoje de um povo europeu não constitui por isso um impedimento, mas sim um apelo ao projecto interrompido de uma Constituição europeia</strong>. Um contrato que deverá ser definido por representantes eleitos dos e pelos cidadãos dos países da União e que, por inerência e por vontade própria, se convertem em sentido próprio em <em>cidadãos europeus</em>.</p><p align="justify"></p><p align="justify"><strong>A Europa não tem um <em>demos</em> porque antes de ser uma realidade é uma utopia. Antes de <em>ser</em>, é um <em>dever-ser</em>.
